For the love and affection I entertain for D.B. Nichols, my Son, and for the further consideration that he has attended to my business, and to me for the last ten or twelve years, I hereby give, transfer and convey to him my several tracts of land in the County of Rutherford and State of Tennessee as further described in this deed, to wit,

Fifty acres by survey bearing date 3 day of May 1831, lying in said County on the waters of Cripple Creek, Beginning at a cedar on the north boundary line of said Nichols, 150 acre survey running thence North forty poles to two walnuts & two cedars, thence East one hundred and thirty poles to a cedar, thence West thirty poles to a stake on said Nichols East Boundary line, thence North with his line 94 poles to a post oak his corner, thence West 100 poles to the Beginning.

Also one other tract or parcel of land containing by Estimation eleven acres on the waters of Cripple Creek in said County of Rutherford and State of Tennessee and bounded as follows, Beginning on a hickory and cedar, running thence North 22 poles to a hickory and post oak, thence West 80 poles to a stake in a large glade, thence South 22 poles to a blue ash, thence East 80 poles running with Jesse Thompson line to the Beginning.

Also one other tract in the said County & State aforesaid, Containing one hundred and fifty acres and bounded as follows, Beginning on a hickory & Elm, thence South 179 poles to a cedar, thence East 134 poles to an ash, thence North 179 poles to a post oak, thence West 134 poles to the Beginning, from the above described tract of land I have sold to Wm. R. Philips fifty acres and I convey to the said D.B. Nichols the said tract subject to said sale and subject to such divisions as the said Philips and the said D.B. Nichols may make between themselves.

Also one other tract containing twenty five acres in the said County and State aforesaid and bounded as follows, Beginning at a chinquapin oak & Spanish Oak, running thence West with Jesse Thompson’s line 46 poles to a cedar said Thompson corner, thence North 6 poles to a stake on said Thompson’s line of another tract, thence West with his line 34 poles to a cedar said Thompson’s corner, thence South 53 poles to a cedar on or near said Thompson’s line, thence East 80 poles to a stake on said Nichols line, thence North with his line 47 poles to the Beginning, the above described tract is conveyed to the said D.B. Nichols subject to a division already made with Jesse Thompson in which the said Jesse Thompson is entitled to twelve and one half acres of said tract, or one half of the said tract.

Also I convey to the said D.B. Nichols one other tract in the County and State aforesaid containing thirty acres and bounded as follows, to wit,Beginning on a hickory and two cedar trees, thence North with J. Thompson’s line 106 poles to a hickory, thence East 44 poles to a stake on Fathera line, thence South 106 poles to a stake, thence West to the Beginning.

To have and hold to the said D.B. Nichols his heirs and assigns forever, I covenant and agree for myself and heirs to warrant and defend the title to the above described tracts of land to the said D.B. Nichols his heirs and assigns against the claims of all persons whatsoever, this 28th day of December 1848.
